Village of Monroe v. Town of Monroe

Partner Brian D. Nugent successfully defended the Town of Monroe in a case brought by two villages against the Town challenging the Town’s determination to tax the cost of the Town’s purchase of open space as a townwide charge.  The villages filed a petition and complaint in the Orange County Supreme Court claiming that such costs could not be taxed to village residents. The Town filed a motion to dismiss the proceeding based on the provisions of New York State Town Law authorizing the town-wide charge. The Orange County Supreme Court agreed with the Town’s arguments and dismissed the Petition and Complaint.
