Village of Walden v. Teamsters Local Union No. 445

Partner Brian D. Nugent successfully represented the Village of Walden in this appellate matter before the Appellate Division, Second Department. The Appellate Division reversed the decision of the Orange County Supreme Court which had denied the Village’s petition to stay arbitration.

The Village sought to stay the arbitration on the ground that there was no agreement between the Village of Walden and the Teamsters Local 445 to arbitrate a grievance. The Village argued that Local 445 was not a party to the collective bargaining agreement between the Village and the Walden PBA and accordingly Local 445 could not properly demand arbitration with the Village under the collective bargaining agreement provisions. The Appellate Division majority agreed with the Village’s argument, permanently staying arbitration and reversing the lower court decision.
