Village of Monroe, et al. v. Town of Monroe, et al.

Partner Brian D. Nugent successfully defended the Town of Monroe in a duplicative proceeding filed by the Villages of Monroe and Harriman that challenged town-wide taxes relating to the Town’s acquisition of open space in the Town. The 2025 proceeding was substantially identical to a prior litigation that had been dismissed in favor of the Town (2024 litigation – Orange County Supreme Court, Index No. EF006346-2024).

The Court agreed with the Town of Monroe and dismissed the Villages’ 2025 proceeding and also granted the Town’s motions for sanctions requiring the Villages to pay the Town’s attorneys fees in defending this 2025 proceeding.
